What happens if I meet a road accident here in Colorado, and it isn’t my fault. I don’t have auto insurance, but can I still demand liability from the person who caused damage to my car?

First of all Tarra, let me tell you something about the part with you not having auto insurance. The thing is, when they find out you don’t have auto insurance, you can be charged or penalized by the law even if it the accident was never your fault. All states in America, including Colorado, require all homeowners to have their vehicles insured.

Okay now, let’s go to the next part. Considering that the investigation results say that you aren’t at fault, then other party is obliged to pay the damages caused by the accident. Provided that his car is also insured, the liability coverage of his auto insurance can be used to repair your car. If the coverage for his auto insurance cannot completely pay for the damages, then he may have to use other insurance like his uninsured motorist insurance – assuming that he has this type of auto insurance.

But then, if he is found to not have any auto insurance coverage (like you), then both of you are in trouble. With this setting, I guess you need to take matters into your own hands and settle the problem personally.
